Mare owner hereby engages service to the stallion Reg. No. for the at $; subject to the following:

1.  Breeding season is from February 1 through June 15th of calendar year.

2. A Booking Fee or $ of the total fee is payable upon signing this contract and the balance of $ IS DUE BEFORE ANY SHIPMENT OCCURS.

3.  A photo static copy of both sides of the registration papers on the mare must accompany this contract. The name of the owner shown on the mare must accompany this contract. The name of the owner shown on the registration certificate will be used on the stallion breeding report.

4.  The owner agrees that in the event the stallion dies or becomes unfit for service or if the mare dies or becomes unfit to breed then this contract is void. The Booking Fee is NON-REFUNDABLE.

5.  If the mare does not produce a live foal (meaning a foal that stands and nurses without assistance) as a result of the breeding, then TRS guarantees a return breeding the following season, subject to the following qualifications:

a.)  The mare is checked pregnant by a vet and later aborts or fails to produce a live foal.

b.) The mare owner must notify TRS within 48 hours in writing after foaling or aborting occurs or the live foal guarantee will be void.

c.)  A $200  Chute Fee will apply to all return breedings.

 6.  Stallion service certificates will be issued only after the owner has notified TRS's Stallion Manager in writing that the mare has produced a live foal, and all expenses, charges, veterinarian expenses and fees due TRS have been paid. If the owner transfers ownership of the mare before foaling, stallion certificates will be issued upon the transfer only when all conditions of this contract have been met.

7.  This contract is not transferable or assignable.

8.  This contract shall be construed and governed by the laws of the State of California. In the event it becomes necessary for either of the parties to this contract to file a suit arising out of this contract, the same must be filed and maintained in the Circuit Court of Riverside County, California. If any legal action is used to enforce the terms of this contract, the prevailing party shall be entitled to receive from the losing party his reasonable attorney's fees, cost of discovery, travel and expense of the suit.

9.  Mare Owner must comply with all rules and registration set forth by the ApHC, AQHA, APHA governing chilled transported semen.

10.  Scheduled collection days are Monday, Wednesday, and Friday.

11.  Shipments will be available on off  breeding days at an additional fee.

12.  A  10:00 a.m. PST cut off on collection days will be strictly followed.

13.  A Collection Fee of  $200  per collection will apply.

14.  Same day shipments are $150  extra charge for courier service to the airport.

15.  All shipping charges will be the responsibility of the mare owner.

16.  TRS  will use disposable containers, which require no deposit, or Equitainer which requires a $300.00 refundable deposit upon return of Equitainer.   A $25  per day fee will apply for each day after (3) three days of receipt of Equitainer that it is not returned to TRS.

17.  Mare Owner will hold stallion owner harmless for any delays in transportation once the semen is shipped by stallion owner or said vet.

18.  Stallion owner will comply with all DNA, permits, etc. as set forth by the ApHC, AQHA, and APHA.

19.  The mare owner shall sign and return a copy of the contract to TRS before it is binding on the parties.

20.  ALL TERMS OF THIS CONTRACT MUST BE COMPLETE WITH TRS BEFORE TRS WILL SEND ANY SHIPMENT.
