Training Contract

This TRAINING  CONTRACT is made and entered into on this                        day of                             , 20            , by and between RAGGIO RANCH hereafter designated "Trainer" and                                                                                                            , hereafter designated "Owner" and if Owner is a minor, Owner's parent or guardian                                                                                               .    Trainer agrees to accept Owner's horse                                                                                              Reg. #                                             for training: and it is the plan and intention of the Owner to place this horse into training.  For and in consideration of the mutual agreements hereinafter set forth, the Owner and the Trainer mutually agree as follows:    

1. Owner shall pay the Trainer for professional services as described below, the fee of $                                  per month.

2. Invoices are payable upon receipt.  On completion of this contract the remainder of expenses shall be due and payable and the horse will not be released from Trainer's possession until all expenses are paid in full.  In the event that payment is overdue by thirty (30) days, Trainer is entitled to a lien against the horse for the amount due and shall enforce the lien and sell the horse for the amount according to appropriate laws of the state.

3. Trainer assumes responsibility for arranging veterinarian and farrier services as necessary.  Trainer will use a veterinarian and farrier of his choice to provide ordinary and necessary care unless owner has requested his veterinarian or farrier to be used.  However, if they are unavailable, Trainer will engage his choice.  All veterinarian, farrier and medicine expenses shall be paid by Owner.

4. The Trainer shall train horse and perform all services in accordance with generally accepted professional standards.  Trainer cannot and does not guarantee the effect of the training program or that any particular results shall be achieved, since this depends a great deal on the individual ability of each horse.  Trainer shall furnish all labor, provide suitable facilities and care for horse in a good and decent manner with feed being determined by training schedule and individual horse.  The Trainer has complete control over the manner of training and shall take precautions for the proper performance thereof.

5. Both parties agree RAGGIO RANCH, the Trainer, their agents and employees are not liable for the death, sickness and/or accident including consequential damages to the horse unless such death, sickness or accident was caused by the willful and wanton negligence on the part of the Trainer and that the Owner is not liable for death, sickness, and/or accident including consequential damages caused by his/her horse unless the Owner had knowledge that the horse had pre-existing problems which were the direct cause of such death, sickness or accident.

6. The horse shall be in healthy and sound condition, free from infectious, contagious, or transmittable disease.  A current Coggins Test, Photostat copy of registration papers (both sides), veterinarian's health certificate, plus a health, worming and immunization record must accompany the horse.  If they do not, Trainer will have horse examined and/or tested at Owner's expense.

7. Trainer reserves the right to notify Owner within seven (7) days of horse's arrival if horse, in Trainer's opinion, is deemed dangerous, handicapped, or untrainable.  In such case, Owner is responsible for removing horse within seven (7) days and for all expenses incurred during horse's stay.  After all fees have been paid in full, this contract is concluded.

8. Trainer shall notify owner as to shows the horse will attend for owner approval of said shows.  Trainer shall provide transportation to and from shows at the rate of $                    per mile, plus $                        per day expenses.

9. Owner shall receive all trophies, ribbons and money winnings.

10. It is agreed that if the horse is sold while in training, a                 % commission shall be paid to Trainer, unless otherwise agreed.

11. Upon thirty (30) days written notice to trainer, the Owner may terminate this Contract for any reason.  The Trainer shall be paid for all fees incurred up to the termination date.  After all fees have been paid in full, this Contract is concluded.

12. It is the responsibility of the Owner to carry full insurance including coverage on his horse and all personal property.

13. This agreement is non-assignable and non-transferable, except as stated above.  This Contract is made and entered into in the State of California and shall be enforced and interpreted under the laws of this state.  Should any clause above be in conflict with State Law, that individual clause shall be null and void.

When Trainer and Owner sign the Contract, it will then be binding on both parties, subject to the above terms and conditions.
